RedVision Terms of Use

1. Acceptance of Terms

By accessing or using the RedVision platform ("Service"), provided by RedVision Studios ("we," "us," or "our"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Status as an Interactive Computer Service & Section 230 Immunity

2.1. Interactive Computer Service RedVision operates as a provider of an "interactive computer service" as defined under 47 U.S.C. § 230(f)(2). We provide a platform that enables computer access by multiple users to a computer server for the purpose of sharing content, utilizing AI tools, and engaging in social networking.

2.2. Immunity from Third-Party Content (The Shield) Pursuant to Section 230(c)(1) of the Communications Decency Act, RedVision shall not be treated as the publisher or speaker of any information, text, images, or media provided by another information content provider (i.e., you, the user). RedVision expressly disclaims any and all liability for data, content, or materials posted, stored, or uploaded by users or third parties. All user-generated content acts as the sole responsibility of the person who originated such content.

2.3. "Good Samaritan" Moderation Rights (The Sword) RedVision reserves the right, but assumes no obligation, to voluntarily take action in good faith to restrict access to or remove availability of material that RedVision, in its sole discretion, considers to be:

  • Obscene, lewd, lascivious, filthy, or excessively violent;
  • Harassing; or
  • Otherwise objectionable.

This right is exercised under the "Good Samaritan" protection afforded by 47 U.S.C. § 230(c)(2), regardless of whether such material is constitutionally protected. RedVision’s decision to curate, edit, or remove specific content does not constitute a waiver of its immunity as a platform, nor does it create a duty to monitor all content posted on the service.

3. Intellectual Property & AI Indemnification

3.1. User Representation of Ownership (Inputs) By uploading, submitting, or inputting any text, images, data, or other materials ("Inputs") into RedVision, you represent and warrant that:

  • (a) You own all rights, title, and interest in such Inputs, or you have obtained all necessary licenses, permissions, and consents to use them; and
  • (b) Your Inputs do not infringe the copyright, trademark, privacy, publicity, or other intellectual property rights of any third party.
  • (c) If your Inputs depict identifiable individuals, you have obtained their explicit written consent to use their likeness for AI generation purposes.

3.2. License Grant to RedVision While you retain ownership of your Inputs, you hereby grant RedVision a perpetual, worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to reproduce, modify, distribute, display, and create derivative works of your Inputs and any resulting AI-generated assets ("Outputs"). This license is granted solely for the purposes of operating, developing, and improving the RedVision service and its underlying AI models.

3.3. Ownership of AI Outputs Subject to your full compliance with these Terms, RedVision assigns to you all of its right, title, and interest in and to the Outputs generated by you using the Service. However, RedVision makes no guarantees regarding the copyrightability of AI-generated Outputs under current law. You acknowledge that Outputs may not be unique and that other users may generate similar or identical content.

3.4. Indemnification for AI Copyright Violations You agree to defend, indemnify, and hold harmless RedVision, its affiliates, licensors, and service providers (collectively, the "Company Parties") from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • (a) Your violation of these Terms;
  • (b) Your use of the Service, including your generation and use of any Outputs;
  • (c) Any claim that your Inputs or your use of the Outputs infringes or misappropriates the intellectual property rights, proprietary rights, or privacy rights of any third party; or
  • (d) The violation of any applicable law or regulation by your Inputs or Outputs.

4. Prohibited Activities & Data Security

4.1. Unauthorized Access and Automated Collection You agree not to access, search, or attempt to access or search the RedVision Service by any means (automated or otherwise) other than through our currently available, published interfaces that are provided by us. You are strictly prohibited from:

  • Using any robot, spider, crawler, scraper, or other automated means or interface not provided by us to access the Service or to extract data.
  • Systematically retrieving data or other content from the Service to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from RedVision.
  • Engaging in any screen scraping, data mining, or harvesting of user content, including but not limited to “profile scraping” or “followers scraping”.

4.2. Protection of Third-Party Platform Data (X/Twitter & Truth Social) RedVision integrates with third-party platforms including X (Twitter) and Truth Social. Your use of RedVision must strictly adhere to the data governance mandates of these partners. You are expressly prohibited from:

  • X (Twitter) Scraping: Using RedVision to scrape, view, or access X content in excess of authorized limits. You acknowledge that under X’s Terms of Service, unauthorized scraping or viewing of posts in violation of their limits subjects the violator to liquidated damages (e.g., $15,000 USD per 1,000,000 posts). You agree to indemnify and hold RedVision harmless for any liquidated damages assessed against us resulting from your unauthorized scraping activities.
  • Truth Social Mining: Using RedVision to engage in any automated use of Truth Social, such as using scripts to send comments or messages, or using any data mining tools to extract Truth Social content, which is a violation of Truth Social's Terms of Service.
  • AI Training: Using any data retrieved from X, Truth Social, or RedVision to fine-tune or train any machine learning or artificial intelligence models, whether generative or otherwise, without express written consent.

4.3. Interference and Reverse Engineering You may not:

  • Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Service.
  • Bypass or circumvent measures employed to prevent or limit access to any area, content, or code of the Service (including "jailbreaking" AI safety filters).
  • Interfere with, disrupt, or create an undue burden on the Service or the networks or services connected to the Service.

5. Fees and Payment Terms

5.1. Paid Services Certain aspects of the Service may be provided for a fee or other charge. If you elect to use paid aspects of the Service, you agree to the pricing and payment terms as we may update them from time to time.

5.2. Payment Processing payment processing services for RedVision are provided by Stripe, Apple Pay, and Google Pay (collectively, "Payment Processors").

  • We do not store your full credit card information on our servers. All payment data is tokenized and processed directly by our Payment Processors.
  • By providing your payment information, you authorize RedVision and our Payment Processors to charge the applicable fees to your designated payment method.
  • Liability Disclaimer: RedVision is not a bank or financial institution. We are not liable for any errors, delays, or security breaches attributable to the Payment Processors. Your use of these payment services is subject to their respective Terms of Service and Privacy Policies.

5.3. Refunds All purchases are final and non-refundable, except as required by applicable law or at our sole discretion.

6. Disclaimers & Limitation of Liability

6.1. No Warranties THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. REDVISION DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6.2. Liability Cap TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL REDVISION BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. REDVISION'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO REDVISION IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
